Slovak Constitutional Court decision confirming court backlogs in a court proceedings in case of discrimination

By its decision of 11 June 2019, the Constitutional Court of the Slovak Republic confirmed that the complainants ´right to hear a case within a reasonable time has been violated. The decision concerns the court proceeding in case of discrimination in access to services which is pending before the domestic courts for more than 13 years. The Constitutional Court awarded the complainants also with financial satisfaction.

The town Spišská Nová Ves discriminated against the Roma woman who applied for a job as a field social worker and must compensate her. This was ruled by the Regional Court in Košice which fully confirmed a decision of the District Court in Spišská Nová Ves from March 2017. It is one of the first final decisions of the Slovak courts in the case of racial discrimination in access to employment in favor of a discriminated person.

The UN Committee on the Elimination of Racial Discrimination (the Committee) calls on the Slovak Government to take effective measures to eliminate discrimination against Roma in various areas of public life. This follows from concluding observations the Committee released after the November session and constructive dialogue held with the Slovak government delegation in Geneva.

We submitted an alternative report to the UN Committee on the Elimination of Racial Discrimination (CERD), which describes selected shortcomings in the implementation of the International Convention on the Elimination of Racial Discrimination by the Slovak Government. In our report we particularly deal with the implementation of the Convention in respect to Roma minority in Slovakia.
