The Implementation of Slovak Anti-discrimination Act at Courts – Practice and Perspective

The project aims to the better implementation of the Slovak Antidiscrimination Act as a legal instrument of protection from discrimination and creating the relevant jurisprudence which will be in compliance with the international legal standards constituted by the European Union and Council of Europe. In the longer perspective the project shall contribute to decreasing the occurrence of discrimination in our society. Within the project we will provide legal representation in two new strategic court proceedings in cases of discrimination on the ground of ethnic origin under the new Slovak Antidiscrimination Act.

We also want to achieve the respective court decisions in cases of discrimination we initiated formerly. As well, we plan to initiate a public complaint (actio popularis) relating to discrimination in order to apply and develop this legal instrument of protection which was incorporated into Slovak legislation in 2008. Through educational activities (seminar, volume of court decisions) we want to bring the topical information on discrimination legislation and its practical use to legal professionals at courts.

The project was implemented in the period from 1 April 2009 to 31 December 2010 and is co-financed by the Financial Mechanism of EEA, Norwegian Financial Mechanism and from the national budget of Slovakia, mediated by Open Society Foundation, Bratislava.
